A standard risk assessment asks what could go wrong operationally, errors, costs, reputational damage. A fundamental rights impact assessment asks a different question: who could be denied a right, an opportunity, or fair treatment because of how this system works, even when it’s functioning as designed.
The EU AI Act requires this specifically for certain high-risk deployments (notably by public bodies and in specified contexts like insurance and credit), but the underlying discipline (considering who’s affected by a decision system and how, beyond the deploying organization’s own risk) is broader than legal minimum and applies wherever an AI system materially affects people’s access to something they’re entitled to.
This is the canonical concept. It stays the same across learner lenses so personalization never changes the underlying facts.
