The EU AI Act regulates AI by the risk of its use rather than by the cleverness of the model. A small set of uses are banned outright; some are treated as high-risk and carry substantial duties; some trigger transparency obligations, like telling people they’re interacting with AI or looking at synthetic media; and the large remainder is largely unrestricted. The obligations attach to how a system is used, so the first practical question is “which tier is this use in?”, not “are we allowed to use AI?”. Getting the tier right is what tells you what you must do before anything else.
This is the canonical concept. It stays the same across learner lenses so personalization never changes the underlying facts.
